Agreement to Terms

By accessing or using Viralyze ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Viralyze is a multi-channel social media management platform that enables users to:

Manage multiple social media accounts from a unified dashboard
Schedule and publish content across various platforms
Collaborate with team members on content creation and approval
Analyze performance metrics and audience insights
Utilize AI-powered content optimization suggestions
Manage comments and messages from a unified inbox

User Accounts

Account Creation

You must provide accurate, complete, and current information during the registration process. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

Account Security

You must immediately notify us of any unauthorized access or security breaches. We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

Acceptable Use Policy

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe upon the intellectual property rights of others
Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Distribute spam, malware, or other malicious code
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with or disrupt the Service or servers
Use automated tools to access the Service beyond our published rate limits
Violate the terms of service of connected social media platforms

Content and Intellectual Property

Your Content

You retain all rights to the content you post through the Service. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing and improving the Service.

Our Intellectual Property

The Service and its original content, features, and functionality are owned by Viralyze and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Billing and Payment

Subscription Plans

Viralyze offers various subscription plans with different features and pricing. All fees are in U.S. dollars and are non-refundable except as required by law.

Free Trial

We may offer a 14-day free trial for new users. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged for the selected plan.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. We will charge the payment method on file at the then-current rate.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period.

Service Availability

We strive to maintain 99.9% uptime, but we do not guarantee that the Service will be uninterrupted or error-free. We may temporarily suspend the Service for maintenance, updates, or to address technical issues. We will provide advance notice of scheduled maintenance when possible.

Third-Party Services

Our Service integrates with third-party social media platforms and services. We are not responsible for the availability, functionality, or content of these third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

Limitation of Liability

To the maximum extent permitted by law, Viralyze shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

Your use or inability to use the Service
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any interruption or cessation of transmission to or from the Service
Any bugs, viruses, or other harmful code that may be transmitted through the Service
Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

Indemnification

You agree to indemnify, defend, and hold harmless Viralyze and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. The invalid or unenforceable provision will be deemed modified to the extent necessary to make it valid and enforceable.
